On 18 December 2018, the Plenary of the Court approved a new Annex to the Rules on arbitration costs, which can be accessed here. The goal of this new text is to offer a simplified and more transparent distribution of the advance on costs paid by the parties between the Court’s administration expenses and the arbitrators’ fees, in line with international best practices.
From the arbitrators’ perspective, the new system brings no economic change, since they will receive the same fees they used to receive. For users, it brings a slight advantage, since in the new system costs are reduced by approximately 0.1%, which the Court will no longer receive.
Consequently, the Annex to the Rules on arbitration costs approved on 18 December 2018, which will come into force on 01 January 2019, will be applicable to cases initiated from that date onwards and also to cases initiated before, unless the parties or the arbitrators prefer to maintain the previous regulation on costs.
